1)  Call to order: The meeting was called to order by Mayor Paul Gowing at 7:30 pm with all members in attendance for the call to order.

3) Declaration of Pecuniary Interest:
John Smuck declared a pecuniary interest for Item No. 11.1-   Delegate power to the County of Huron for Woodlot by-law, since he has a personal litigation in regards to the Tree by-Law. No other member declared a pecuniary interest, at this time.

4) Minutes:

5) Business from the Minutes
Jason Breckenridge will update the Council on Bluevale Pioneer Park  and MVCA in his Council Report.
There was no other business from the minutes to be discussed.

6) Accounts

"That the Accounts dated May 21st, 2013 be approved for payment in the amount of  $ 76,193.41.”

10)  Business:

10.1  Fire Suppression Agreement with Huron East
Motion:  205-2013      Moved by Jamie Heffer                       Seconded by Neil Warwick
“That the Council of the Municipality of Morris-Turnberry  contact Huron East to renew the Municipality of Huron East Fire Agreement for the years 2014 – 2019.”

10.2     Enabling Accessibility Funding
The Council was advised that a letter was received advising thatMorris-Turnberry was not eligible for funding.

7)  4th and 5th Draft Animal Control By-law                                          7:40  pm
1.Bob Trick- Animal Control Officer was in attendance for the review of the 4th and 5th draft of the Animal Control By-law.

Sherry Pulles, Mike Clarke, Luke Clarke, Mike Wick, Jennifer Wick, Jeanette Walker, Myron Shwadchuck, Carole Rose, Dianne Campbell and Jim Newell were in attendance.

2.Mike Clarke:   Deputation - Animal Control By-law 1.Presentation – Mike Clarke made a presentation to the Council regarding the Animal Control By-law.

2. Petition – A petition regarding the Animal Control By-law was presented to the Council.

“That the Council of the Municipality of Morris-Turnberry receive the petition submitted in regards to the Animal Control By-law.”
Disposition      Carried

Mayor Gowing explained to the group that the Council does not plan to set up a community committee for review of the Animal Control By-law.

3.Motion Consideration  of the By-law:

Motion:  207-2013      Moved by Jason Breckenridge Seconded by Jamie Heffer
“That the Council of the Municipality of Morris-Turnberry defers the Animal Control By-law for one month.”
Disposition     Carried

The next draft will be added to the June 18th Council meeting and further Council comments must be submitted by June 4th.

8)  Public Works:    Gary Pipe – Director of Public Works                 8:50 pm

1.Annual Monitoring Report for the Morris Landfill Site:

Motion:  208-2013      Moved by Jason Breckenridge Seconded by Neil Warwick
“That the Council of the Municipality of Morris-Turnberry hereby receives the 2012 Annual Monitoring Report- Morris Landfill Site.”
Disposition      Carried

Steve Fortier joined the meeting at 8:55 pm.

Sherry Pulles, Mike Clarke, Luke Clarke, Mike Wick, Jenn Wick, Jeanette Walker, Myron Shwadchuck, Carole Rose, Dianne Campbell and Jim Newell left the meeting at 8:55 pm.

Bob Trick left the meeting at 9:00 pm.

2. Doerr Municipal Drain

Motion:  209-2013      Moved by Jason Breckenridge Seconded by Jamie Heffer
“That the Council of the Municipality of Morris-Turnberry authorizes R J Burnside& Associates to prepare a new maintenance assessment schedule for the Doerr Municipal Drain
due to the fact that the 1977 report has the former railway lands assessed that are now incorporated with the adjacent properties.”

3. Armstrong Municipal Drain:

A motion was made May 7, 2013 to accept the petition under Section 78 of the Drainage Act. 
The engineer has stated the work is under Section 4 of the Act.  Therefore an amended motion would be required:

“That the Council of the Municipality of Morris-Turnberry accept the petition for improvement to  the Armstrong Municipal Drainage works at Concession 11 Part Lot 9 and 10, Turnberry, under Section 4 of the Drainage Act;   and that RJ Burnside  & Associates Limited, be appointed to prepare a report;  and that Motion No. 183-2013 be hereby rescinded and repealed.”

Gary Pipe gave a report on the Calcium Chloride application.

Steve Fortier presented the March and April monthly report.

The Confidential Report was handed out at the meeting for the council’s information.

9.2  Disposal of Property at 83019 Brussels Line

Motion:  212-2013      Moved by Jason Breckenridge Seconded by Neil Warwick
“That the Council of the Municipality of Morris-Turnberrydeclare the property of 83019 Brussels Line as surplus to the needs of the Municipality of Morris-Turnberry; and obtain
2 ‘opinion of value’ for the property and advertise the property for sale by tender.”

10) Business Continued:

10.3 Municipal Insurance Quote with BFL Canada
The staff will be proceeding with an RFP for Municipal Insurance coverage, effective January 1, 2014 pursuant to the Motion: 431-2012.

10.4  Ontario Provincial Police 2014 Annual Salary
A letter was attached for the Council’s review and filed.

10.5  Meetings and Office Hours for the Summer Months

“That the Council of the Municipality of Morris-Turnberry agrees to the Report for the Council Meetings and Office Hour Schedule for the summer months of July – August, 2013; 
summer council meetings will be:  July 2nd,  July 16th and August 6, 2013.”

10.6 Fire Boundary Polygon Changes Date

“That the Council of the Municipality of Morris-Turnberry approves the cost of $3,056.00 plus taxes, for the fire polygon change in the Emergency Service Zone.”

“That the Council of the Municipality of Morris-Turnberry defers the effective date until the matter has been discussed with North Huron and Howick .”

10.7  Code of Conduct:

The County Council Code of Conduct was reviewed by Council.


Morris-Turnberry has to amend the Procedural by-law to reflect the size of council change and the Deputy Mayor position, so part or all of this code should be incorporated in the Procedural By-law.  

The issue of the Deputy Mayor will have to be noted. The Council suggested that the by-law should be effective for the new Council,  December, 2014.

11) By-laws

John Smuck declared a pecuniary interest and left the table for ‘Delegate the County to pass Woodlot by-laws’.

11.1 Delegate the County of Huron           to pass Woodlot by-laws

"That By-Law No. 37-2013 be adopted as given first, second, third and final readings being a by-law to delegate the County of Huron all or part of the Municipality’s power to pass a by-law in respect of the destruction or injuring of tress in woodlots, for the Municipality of Morris-Turnberry as amended.”

11.2     Demolition Agreement

Motion:  218-2013      Moved by Jason Breckenridge             Seconded by Jamie McCallum
"That By-Law No. 36-2013 be adopted as given first, second, third and final readings being a by-law to authorize an agreement for the Demolition of the Residence ‘located at the Part of the North Part of Lot 8 Concession 2, RP 22R5518 Part 1 Morris Ward” in the Municipality of Morris-Turnberry.”

11.3  Agreement for the Turnberry Landfill Site

Motion:  219-2013      Moved by Jamie Heffer                       Seconded by Jason Breckenridge
"That By-Law No. 35-2013 be adopted as given first, second, third and final readings being a by-law to adopt an ‘Underground Investigation Work’ Agreement for the Turnberry Landfill Site, with ‘Marlene Marie Metcalfe’, for the Municipality of Morris-  Turnberry.”

12) Council Reports:

Jason Breckenridge:
He reported that the Bluevale Recreation is taking the storage shed and food booth buildings down with the help of MVCA and Public Works. They are fixing the ball  lights.
They are discussing a permanent Liquor Licence at the Bluevale Hall.
Bluevale Homecoming will be next year.
He will be going to a Bluevale Hall Board meeting.
MVCA is looking at leasing out the BenMiller Falls Reserve Park.

Jamie McCallum:
He attended a CHIP meeting on May 8th.  They are doing radio ads and will have stats at the next meeting.
On May 10th he attended the Bruce Power Event.

Jamie Heffer:
He attendeda Belmore Community Centre meeting on May 20th.  The compressor needs rebuilding.  There may not be hockey next year but curling will continue.

David Baker:   No report.

John Smuck:   No report.

Neil Warwick:
Charlie Johnston may have a compressor for the Belmore Community Centre.

Paul Gowing:
He will be attending the Road Closure meeting on May 22nd.
On May 30th he will be attending an Accessibility meeting with ‘Alvin Law’ and he was planning to go
to the Huron Manufacturing Dinner, however cannot attend, so  Jason Breckenridge will be going in his place.
