COUNCIL CHAMBERS

Minutes of the Meeting

1)      Call to order:     The meeting was called to order by Mayor Paul Gowing at 5:30 pm with all members in attendance.

2) Agenda:

Adoption of Agenda:

Motion:  176-2011  Moved by            Jason Breckenridge      Seconded by  Jamie McCallum

“That the agenda for the meeting of  April 28th , 2011 be adopted as circulated.”

Disposition          Carried

3) Declaration of Pecuniary Interest:

Paul Gowing declared a pecuniary interest for Item 6.3 Mustard Drain since he is a landowner on the Mustard Drain.

No other member declared a pecuniary interest, at this time.

4) Meeting with Kent Hunter and Joy Rutherford- R J Burnside and Associates  5:30 pm

Kent Hunter and Joy Rutherford were in attendance to review:

1.  The current status of the landfill

2.  The movement to Stage 1 and 11

3.  The future expansion of the landfill

4.  Waste Strategy process and the engineering involvement

5.  2011 Budget estimates

Kent Hunter and Joy Rutherford reviewed a power point presentation and reviewed the various points.

Motion:  177-2011  Moved by            Jason Breckenridge      Seconded by  John Smuck

“That the Council of the Municipality of Morris-Turnberry approve the budget estimate for the Morris Landfill Site, except Number 7 – Waste Strategy,  for futher detail on the cost and requirements for a Waste Strategy  and Number 8,  Tendering- until more information on the costs of construction are received..”

Motion:  178-2011  Moved by            Jamie Heffer                Seconded by  David Baker

“That the Council of the Municipality of Morris-Turnberry approve that R J Burnside and Associates proceed with the preliminary hydrogeological investigation for the landfill, to determine:

1.  Maximum site development, with or without CAZ

2.  Development of the maximum footprint without any engineering controls.”

Disposition      Carried.

Break:

The Council took a short break at 7:10 pm   and Kent Hunter and Joy Rutherford and Gary Pipe, left during the break.

Reconvened the meeting:

The Council reconvened the meeting at 7: 35 pm.

5)   Business:

5.1       Resolutions

Motion:  179-2011  Moved by            Neil Warwick               Seconded by  Jason Breckenridge

“That the following resolutions be supported and endorsed:

1.  Halton Region – HST

2.  City of Mississauga – HST

3.  Municipalities in the County of Huron – Closure of Jails.”

Disposition      Carried.

5.2   Brussels Cemetery Donation

This item is deferred until further information on the grant request, has been received from Huron East.

5.3   Clyde Street Drain

Request from property owners to pay drainage invoice over 3 years.

Motion:  180-2011  Moved by            Jamie McCallum                      Seconded by  Jason Breckenridge

“That the Municipality of Morris-Turnberry approve payment over 3 years for 131 Clyde Street and 133 Clyde Street for the Clyde Street Drain.”

Disposition      Carried.

5.4  Road Tolls

1.  Howick Lions

Motion:  181-2011  Moved by            Jamie McCallum                      Seconded by  David Baker

“That the Council of the Municipality of Morris-Turnberry approve the  request from the Howick Lions for a Voluntary Road Toll on Friday May 23, 2011 and September 25, 2011 from 3:00 pm to 8:00 pm and shall be responsible for all costs, including County related costs,   if necessary and responsibilities and liabilities associated with the voluntary road toll, including maintenance and restoration of the detour roads if applicable; a copy of a Certificate of Insurance is required and the County of Huron letter be signed and submitted to the County of Huron.”

2. Belgrave Kinsmen

Motion:  182-2011  Moved by            Jamie McCallum                      Seconded by  John Smuck

“That the Council of the Municipality of Morris-Turnberry approve the request from the Belgrave Kinsmen Club and authorize that a by-law be prepared to allow Voluntary Road Toll on Friday May 20, 2011 and September 5, 2011 from 9:00 am to 6:00 pm and shall be responsible for all costs, including County related costs,   if necessary and  responsibilities and liabilities associated with the voluntary road toll, including maintenance and restoration of the detour roads if applicable; a copy of a Certificate of Insurance is required,
to cover the period of time set out in the request  and the County of Huron letter be signed and submitted to the County of Huron.”

5.5  Wingham Firefighters Association

Break Open Tickets

Motion:  183-2011  Moved by            John Smuck                             Seconded by  Jamie McCallum

“That the Council of the Municipality of Morris-Turnberry has no objections to the Break Open Ticket lottery licence for the Wingham Firefighters Association.”

Disposition      Carried

Steve Fortier joined the meeting, at this time.

5.6 Blyth Festival

Performance Host for the 2011 Summer Season

Motion:  184-2011  Moved by            Jason Breckenridge                  Seconded by  Jamie McCallum

“That the Council of the Municipality of Morris-Turnberry be a Performance Host for the Blyth Festival Summer Season 2011,   in the amount of $400.00 .”

Disposition      Carried

5.7 Paperless Agenda

A report was presented on the cost of paperless agenda and the savings.

Motion:  185-2011      Moved by  Jason Breckenridge                        Seconded by  John Smuck

“That the Council of the Municipality of Morris-Turnberry proceed with the Paperless agenda and that the clerk shall obtain quotes for the lap tops and electrical connection and proceed to implement the process,  pursuant to the estimate of costs.”

Disposition      Carried

The JEPP application, to offset costs for supplies for the Council Room/ EOC , was not approved, at this time,  however the application remains on the waiting list with EMO.

5.8       Physician Recruitment Dinner and Auction              May 17, 2011

Motion:  186-2011      Moved by Jamie Heffer                                   Seconded by Jason Breckenridge

“That the Council of the Municipality of Morris-Turnberry donate one History Book to the Physician Recruitment Dinner and Auction on May 17, 2011.”

Disposition      Carried.

5.9       2011/2012 Tile Loan Program

The 2011/12 criteria for Tile Drainage loans was submitted to the Council, for  information.

5.10     Fire Seminar:

1.  Essentials of Municipal Fire protection – A Decision Makers’ Guide Seminar

Wednesday, May 18, 2011, Stanley Complex @ $30.00

Jason Breckenridge and Dave Baker attended a session in Palmerston . They felt that the session was interesting,  but too in-depth for Council members.

No other Council member will attend the Stanley complex session.

2.  Ontario Association of Fire Chiefs

OAFC Municipal Politicians Seminar, May 1 and May 2, 2011 @ $350.00

No council member will attend.

5.11  Drinking Water Source Protection   - May 4th , 2011   9:30 am  to   3 pm

No council member will attend.    They are more interested in the Ausable Bayfield CA session.

5.12 BM Ross  60th Anniversary celebration  may 11th, 2011   4:30 pm to  7:30 pm

Paul Gowing and Jamie McCallum wish to attend from Council.

6) By-laws:

6.1    By-law to approve the 2011 budget and adopt tax rates for 2011:

Motion:  187-2011  Moved by            John Smuck                 Seconded by  Jason Breckenridge

" That By-Law No. 23-2011 be adopted as given first, second, third and final readings   being a by-law to approve the 2011 budget and adopt the 2011 tax rates for the   Municipality of Morris-Turnberry.”

Disposition      Carried

The clerk explained to the Council that the staff will proceed with the items in the budget and bring reports to the council, as required for quotes and tendering.  A monthly financial statement will be attached to the second meeting of the month,  for council review.

6.2       By-law to Adopt the McDonald Municipal Drain Report 2011

Motion:  188-2011      Moved by        Jamie Heffer                Seconded by   Neil Warwick

" That By-Law No. 9-2011 be adopted as given third and final readings being a by-law to adopt the McDonald Municipal Drain Report 2011.”

Disposition      Carried.

Paul Gowing declared a Pecuniary interest, for the next item and left the table.

6.3   By-law to Adopt the Mustard Municipal Drain Report 2011

1. Chairperson:

Motion:  189-2011      Moved by   Neil Warwick                    Seconded by  Jamie Heffer

" That Jason Breckenridge be the Chairperson for  the Mustard Municipal Drain Report 2011 By-law,  as Mayor Gowing, has declared a pecuniary interest. ”

Disposition      Carried.

2. By-law to Adopt the Mustard Municipal Drain Report 2011

Motion:  190-2011      Moved by   Nail Warwick                    Seconded by  John Smuck

" That By-Law No. 9-2011 be adopted as given third and final readings being a by-law to adopt the Mustard Municipal Drain Report 2011.”

Disposition      Carried.

Jamie McCallum questioned if Mayor Gowing should sign the by-law, since he declared a pecuniary interest. The Clerk advised that the Mayor and Clerk, sign on behalf of the Municipality, as directed council.

Mayor Gowing returned to the table.

7)  Council Reports:

Jason Breckenridge:

He had in his possession a Fire Protection Guide from the Fire Essentials Seminar.

He attended the Belmore Maple Syrup Festival, for the history book  and the History book review, in Bluevale.

The Bluevale Recreation cleaned up at the Bluevale Park, for spring cleanup.

Jamie McCallum:

He missed the Economic Development meeting,  which is this same date.

He attended a Chip meeting.  Four municipalities and the County have contributed.  They are planning clinics for safe driving.

Jamie Heffer:

He attended a Drainage Course in Guelph and received information on Municipal and Mutual drains and tile drain loans.  He felt that the information that he received was applicable to Bluevale, as the municipality has the right to refuse a petition, with a valid reason.

David Baker:

He attended the Brussels, Morris and Grey CC meeting.  They were not successful for the grant for the dressing rooms.  The board is approaching Huron East and Morris-Turnberry for assistance to purchase a new ice machine.

He attended a MVCA meeting.  A new van was purchased.  The authority wanted permission to obtain an extension of time for the processing of building permit reports.  However, that was not approved by the board.

John Smuck:

He attended a Physician Recruitment meeting on April 11th.  The Golf Ball Drop is the 1st week of June. The minutes will be forwarded.

April 14th, he attended a Farm and Safety meeting.

April 26th, he attended a drain meeting in South Bruce.  The Court of Revision will be held on May 24th.

Neil Warwick:

April 15th, he attended the Municipal Officers meeting and was appointed to the Groundwater Protection Committee.

Paul Gowing:

The Public meeting in Bluevale, April 14th when well.

April 15th – attended a RED Grant presentation at Green’s Meat Market  and the Municipal Officers Meeting.

April 21st-  He and Nancy Michie attended the Huron Perth Health Alliance in Seaforth.

April 27th – He attended with Gary Pipe and Stu Moffat, the Road Superintendents meeting.  There was a presentation on the new requirements for the reflectivity road signs.

11)  Steve Fortier Report:

1.  Accessibility Report

Steve Fortier is the Morris-Turnberry representative on the Huron County Accessibility Working Committee.  He presented a report , dated April 12,2011,  on the Accessibility standards and the County by-law.

The Council will have to give consideration to a by-law to adopt the new County by-law, in the near future.

2.  Low Frequency Noise Committee Meeting     - report of Steve Fortier

Steve Fortier is the Morris-Turnberry representative on the Huron County Low Frequency Noise Committee.  He attended a meeting, April 5,2011.   A further report will follow.

Keith Roulston left the meeting, at this time.

12.1  Enter into Closed Session:

“That the Council adjourn the Public Session of Council and enter into a Closed to the Public Session for a matter pursuant to the Municipal Act, Section 239 (2)  (e) litigation or potential litigation;   and
(b)  Identifiable Individual  , at 9:10 pm.   ”

Disposition      Carried.

Steve Fortier left the meeting @ 9:55 pm.

“That the Council adjourn the Closed to the public session and re-enter regular open session of council, at 10:07 pm.”

12.3  Report to the Public from Closed Session.

The Council reviewed legal and personal issues.

12.4     Municipality of Morris-Turnberry Support:

“That the Council of the Municipality of Morris-Turnberry support the judicial review, as recommended by Mayor Gowing and hereby agree to pay legal costs, to a maximum of $2,500.00.”

13)  By-law 25 - 2011    Confirming by-law

Motion:  194-2011       Moved by Jamie McCallum               Seconded by  John Smuck

"That By-law No. 25 -2011 be passed as given first, second, third and final readings, being a by-law to Confirm the actions of  the Municipality of Morris-Turnberry for the meeting April 28, 2011."
