Monday,  May 28, 2012  7:30 pm

1)  The meeting was called to order by Mayor Paul Gowing at 7:30 pm with all members in attendance for the call to order.

Purpose:  The Mayor called this special meeting to deal with the mailing of the  comment sheet for the fire service

28 people were in attendance.

2)  Declaration of Pecuniary Interest:
No member declared a pecuniary interest, at this time.

3)  Agenda
John Schwartzentruber requested to book 4 people for deputations.
The Mayor advised the group that the deputations had to deal with the purpose of the meeting.  
One deputation was deferred to June 5th  and  one person was not in attendance.  Therefore,   two deputations were given consideration by council, as the presenters advised that the subject was in regards to the Comment sheet.

“That the agenda for the meeting of   May 28, 2012 be adopted as amended, to authorize two deputations in regards to the comment sheet for the fire service; the deputations will be heard prior to the  item 4.1  Letter from four (4) ratepayers .”
Disposition   Carried.

4)   Business:
1.  Comment sheet to be mailed to the public in regards to fire service:

1. John Schwartzentruber:
He questioned the fairness of the comment sheet. This should be a democratic process. He recommends build a community and not destroy it.
Mayor Paul Gowing explained that the comment sheet was not to be presented, as it was planned.  
It was planned for presentation following the question period.  He advised  that he gave direction for a legal opinion on the matter. The Municipality wants comments to move forward.

2.  Cynthia Moyer  -President, Ontario Landowner’s Association, Huron/Perth Chapter.
She represents an organization to protect property rights.  There are benefits to the  process if the community participates.  She is happy that the council is having a second look at the ballot. Polling the community is a factor,  costs are another factor.
Mayor Gowing explained that this is not a ballot, it is a comment sheet.
The council will exercise its discretion with the results.  This is a method for public input. This project has been reviewed for three years.
Lynne Armstrong-  commented there are ways for surveys to come back, a numbering system, maybe scruinteers.
Chris Palmer – questioned if the comments will be for information.  A ‘no response’ would not be correct, either.
The council echoed that this is for public comment, only.

2.   Letter from 4 ratepayers, received May 25, 2012.
Mayor Gowing presented the letter received on Friday May 25,2012,  from four ratepayers, requesting
that the comment sheet not be mailed, as written.

Mayor Gowing advised the council that he had talked to Reeve Neil Vincent, from North Huron, who was going to talk to the North Huron  Council about possible negotiations.

“That the line in the ‘Comment Sheet for the fire service,  ***If this form is not returned, it will be considered that you are ‘ in favour’ of proceeding with the formation of a Morris-Turnberry Fire Department’  be removed and add a line to the effect of ‘ Your comments are important’  and defer the mailing of the comment sheet for 4-5 weeks,  for negotiation with North Huron .”
Disposition   Carried.

2.  Request of the Ontario Ombudsman for a Closed meeting investigation
Mayor Gowing requested that Nancy Michie explain the request from the Ontario Ombudsman.
On Friday May 25, 2012,  the Municipality was contacted that a person or persons had contacted the Ontario Ombudsman and questioned the council dealing with acquisition of property in a Closed session. The office of the Ombudsman advised the caller that a council has the right to discuss the acquisition of property in Closed session.    The required documents will be sent to the office of the Ombudsman for the review.

5)  Adjournment:

“That the meeting be adjourned at  8:35  pm and this is deemed to be less than 2 hour meeting .”
